Datepetlovers.com is an online dating service providing a way for adults members to communicate and connect with one another. If you do not agree to the following Terms of Use Agreement, you may not use the service and should not register. We do not screen our members, however each and every member is approved, or not approved through a human process. Allow a maximum of 12 hrs for all upgrades to a paid membership. All memberships must be activated within 7 days or will be deleted. A valid email address is required for membership.
1. Acceptance of Terms of Use.
Welcome to the Datepetlovers.com Dating Site! (Hereafter “the site”, “the service”, “we”).
Upon completion of the registration process and by checking the appropriate box you agree to these Terms of Use (hereafter “the Agreement”). If you register to become a Free or Paid member, (hereafter “Member”, “Members”, “You”, “Yourself”) you agree to provide accurate, current and complete information about yourself as requested in our registration process and maintain and update this information as necessary to keep it accurate and current. Furthermore you agree to use this service in accordance with all laws and regulations where applicable.
2. Adults Only - Minors May Not Use This Site.
You represent and warrant being at least 18 years of age or of the age of majority in your jurisdiction, and have the right, authority and capacity to agree to and accept this Agreement.
3. Changes to Terms of Use Agreement.
We reserve the right to change, amend or supplement these Terms of Use at our sole discretion and provide you with reasonable notice of such changes. Continued use of this service by you after such changes have been implemented represents your acceptance of the changes.
4. Changes to the Site and Service.
We, at our sole discretion, may add, delete, or change the services, functions or features of the site and service.
5. Membership Cancellation.
We reserve the right to refuse membership to anyone. At our sole discretion, we may cancel your membership, any or all parts of your information, communications, or postings, without notice for conduct that violates or is in breach of this Terms of Use Agreement. Upon our cancellation of your membership by us, we may continue to deny you membership and use of the service in the future. This Agreement will be in effect even after a membership is cancelled.
6. Content Posted by Member.
You agree to be solely responsible for the content or information you publish or post on the site, or send to other members using this service. You will not post or send to other members or to our staff anything (this includes but is not limited to: text, photos, videos) that is harassing, abusive, offensive, racially offensive, bigoted, obscene, profane, pornographic, sexually explicit, hateful, violent, inaccurate, unlawful, illegal, slanderous, libellous or otherwise objectionable.
Any posting of contact information in your personal profile including but not limited to: email addresses, phone numbers, URLs, Instant Messengers handle or any type of numeric or personal identification is a violation of this agreement. We will remove any such contact information we find in personal profiles. We are not responsible for any interactions occurring between members after such contact information has been privately exchanged.
a) Photos posted in personal profiles must be of yourself and yourself only.
b) Do not post photos of nudity. This includes of you and of others.
c) Do not post public photos of minors.
7. Non Commercial Use of the Site by Member.
You will not use the service to post, send or distribute any material containing any solicitation for funds, advertising , solicitation of goods and services or other commercial mean. You will not transmit any chain letters or junk email (spam mail) to other members. Doing so will result in cancellation of our service to you.
8. Copyrighted Material.
You will not post text, graphics, photos or use the service in any way which violates, plagiarises or infringes on the rights of any third party, including but not limited to, copyright or trademark law, privacy or other personal proprietary rights.
You represent and warrant that you are the exclusive author of your profile and exclusive owner of your photographs posted on Datepetlovers.com. You assign to us all rights, full title and guarantee all copyright in your photographs and profile.
All material in the Datepetlovers.com site, including but not limited to: text, graphics, photos, and software is protected by Copyright Laws. You may copy and download this material for personal use only. You may not copy, reproduce, retransmit, distribute, publish, commercially exploit, or otherwise transfer copyright material in any format, electronic or otherwise without our written consent.
9. Your Account and Password.
You are responsible for keeping your personal identifying information and password private and confidential. You are responsible for all uses of your account whether or not it was authorised by you.
You will immediately notify abuse [at] datepetlovers [dot] com of any unauthorised use of your account. You will be liable for all charges that accrue to your account through your use or of those you have authorised. You agree to pay all charges owing on your account. You may cancel your membership at anytime.
10. Refunds.
Refunds are issued at the sole discretion of Datepetlovers.com. Refunds are to be credited to the same credit card used at the time of the initial purchase. There shall be no refund given in the event Datepetlovers.com cancels your membership or bans you from the Datepetlovers.com website.
11. Intellectual Property.
All intellectual property rights in the service and web site shall by owned by us absolutely. These rights include but are not limited to: database rights, copyright, graphics, design rights (registered or unregistered) trademarks (whether registered or unregistered) or any other similar rights regardless of jurisdiction.
12. Privacy and Information Use.
Upon using the service you have also agreed to our Privacy Policy. You acknowledge that the personal information (including sensitive personal information) you provide to us will be stored in our computers. You consent to us using this information to build up a profile of interests, preferences and browsing patterns and to allow you to participate in the service. You also agree to uphold and maintain Datepetlovers.com Privacy Policy and to the Terms of Use thereof.
You acknowledge that:
a) We cannot ensure the security or privacy of information you provide through the Internet or your email messages and as such you release us from any responsibility.
b) We cannot control the content of messages sent to you by others and as such release us from any responsibility.
c) We cannot control the use of information provided to others by you and as such you release us from any responsibility.
d) We do not guarantee nor warrant the accuracy of information provided by other users of the service, nor do we assume responsibility for verifying this information.
13. Disclaimer.
We provide this service on an “As Is” basis and grant no warranties either implied, expressed or statutory in any communication with our representatives or us. We specifically do not warrant that this service will not be uninterrupted or error free and there may be delays, omissions and interruptions. We do not warrant the accuracy of any member profile or any communication from them or about them displayed or transmitted to you. We cannot guarantee that each member is at least the required minimum age, nor do we accept responsibility or liability for any content, communication or other use or access of the Service by persons under the age of 18 years old in violation of this Agreement. You acknowledge that any reliance upon any such member profile; opinion, advice, statement or information shall be at your own risk.
14. Testimonials.
Any messages, statements displayed on a member’s testimonial are provided for entertainment purposes only and are not intended and should not be taken as specific advice, opinion, beliefs, statement of fact by the others. These opinions, statements and beliefs belong to their authors only and do not represent the opinions, statements or beliefs of Datepetlovers.com.
15. Limitation of Liability.
In no event, will Datepetlovers.com be liable;
a) To you for any incidental, consequential, or indirect damages (including but not limited to,
damages for loss of data, loss of programs, cost of procurement of substitute services or service
interruptions) arising from the use of or the inability to use the service or the site, even if
Datepetlovers.com or its agents or representatives know or have been advised of the possibility of such
damages, or
b) To any person other than you. Notwithstanding any contrary provision herein but subject to the
foregoing limitation on liability, in all events Datepetlovers.com`s liability to you for any cause whatsoever,
and regardless of the form of the action, will at all times be limited to the amount paid, if any, by
you to Datepetlovers.com for the service during the term of membership.
16. Indemnity.
You agree to indemnify our parent companies, officers, directors, employees, agents, and us for any losses or damages. These may include, without limitation, reasonable legal fees, which we may suffer from your activities or your the use of the service. These activities may include, without limitation, any breach by you of this Agreement or charges or complaints made by other parties against you.
17. Legal Venue.
You agree that the Laws of the Province of British Columbia, Canada shall govern this agreement and any dispute arising out of this Agreement will be disputed in the courts of Vancouver, British Columbia, Canada.
18. Complaints.
To resolve a complaint regarding the service or the site, you should contact Datepetlovers.com via our Contact Us form or by regular mail at Datepetlovers.com c/o Versatile Visions Inc, Suite 608 280 Nelson Street, Vancouver, British Columbia, Canada, V6B 2E2.
19. Assignment.
We have the right to assign any or all of its rights and duties under this agreement to anyone either in whole or in part.
You do have any right to assign this agreement either in whole or in part.
20. General Provisions.
This Agreement, accepted by you upon registering for the service, contains the entire agreement between you and Datepetlovers.com regarding the Service and the Site, including the Datepetlovers.com Privacy Policy. In the event of any conflict between the Privacy Policy and this Agreement, this Agreement shall prevail. Unless otherwise explicitly stated, these Terms of Use will survive termination of your membership to the service. This Agreement shall terminate immediately and without notice if you breach any of the terms, subject to the survival of all rights and reservations of Datepetlovers.com. If any provisions of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
This certifies that the Member has read and agrees to be bound by all provisions contained above.
